Thaler Reaches Pinch Point: Tribunal Denies Urgent Stay Request on Suspension

Snowy Monaro Regional Councillor Andrew Thaler faced the NSW Civil and Administrative Tribunal yesterday, Thursday May 15, 2025 attempting to overturn a suspension imposed by the Office of Local Government (OLG).

As reported by the Sydney Morning Herald in an article written yesterday, his lawyer, Mark Davis, argued before the tribunal that despite Thaler’s reputation as a “rude fellow” who “swears,” these behaviours did not constitute sufficient grounds for the suspension of an elected official. Davis contested the imposition, claiming the ban was an overreach by the bureaucracy and undermined the democratic process.

The tribunal was informed that Thaler’s comments had caused distress among council staff, leading some to feel anxious and intimidated. Despite these grievances, Davis maintained that Thaler had apologised for his language and actions, describing the suspension as an “improper impost” on his duty to serve the community.

The OLG, represented by barrister Matthew McAuliffe, defended the suspension, emphasising the need to safeguard council members and employees from Thaler’s serious misconduct. McAuliffe conceded that suspension of elected officials entails careful consideration, yet asserted that in Thaler’s case, it was justified due to his “serious and grave misconduct.”

Ultimately, the tribunal denied Thaler’s request for an urgent stay on his suspension. Thaler’s appeal against the ban is scheduled to be heard on June 6, 2025. Mr Thaler told Snowy Mountains News he will contest the decision as planned, but thinks his “chances are zero.”
